The company named in the legal notice is the author of this privacy policy and the owner of the information (data) collected about you under this privacy policy. The General Terms and Conditions (GTC) of the company also apply.

Data of Swiss customers and Swiss visitors to our website
The processing of data of Swiss customers is governed exclusively by Swiss law, in particular the Federal Act on Data Protection (FADP, SR 235.1) and the associated Ordinance to the Federal Act on Data Protection (SR 235.11). The EU General Data Protection Regulation (GDPR) does not apply. The applicability of the GDPR remains reserved (i) insofar as it is expressly provided for in this data protection declaration for sub-areas, and (ii) insofar as the GDPR is also mandatory for data of Swiss customers due to special circumstances.

If the processing or storage of personal information takes place in countries that do not guarantee adequate data protection compared to Swiss data protection law, we require the processor to fully comply with the relevant provisions of the FADP or - insofar as data of customers from the EU area are concerned - the GDPR under contractual obligation.

We have individual of the aforementioned processes and services carried out by service providers commissioned in accordance with data protection law. These are companies in the categories of IT services, payment transactions, billing, debt collection and consulting as well as sales and marketing and service providers that we use in the context of order processing relationships.

This prevents activity data from being shared with Google Analytics via the JavaScript executed on websites (ga.js, analytics.js and dc.js).

The analysis of data by other tools of the website owner is not prevented when you use the add-on. Data can still be sent to the website or to other web analysis services.

Finally, we collect certain information via our website in so-called server log files, which your Internet browser automatically transmits to us. Technologies for advertising purposes

This function makes it possible to link the advertising target groups created with Google Analytics Remarketing with the cross-device functions of Google AdWords and Google DoubleClick. Plugins from the Vimeo video portal of Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA are integrated on our website. Each time you access a page that offers one or more Vimeo video clips, a direct connection is established between your browser and a Vimeo server in the USA. Information about your visit and your IP address is stored there. By interacting with the Vimeo plugins (e.g. clicking the start button), this information is also transmitted to Vimeo and stored there. 7. communication by email and/or newsletter

If you would like to receive a newsletter offered on our website, we require an e-mail address from you and other information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter ("double opt-in" procedure). 

With the newsletter, users regularly receive recommendations and offers that may be of interest to them. For this purpose, we collect and process personal data regarding their usage behavior on our website and how they use our newsletters (e.g. whether they open the newsletter or which web URL links they click on). We evaluate this data for statistical purposes in order to better tailor the content of the newsletter to the interests of the users. 

The processing of the personal data entered in the newsletter registration form is based on your consent, which you can revoke at any time for the future. The revocation is made via the "unsubscribe" link in the newsletter. We use the personal data collected from you to design the content and send the newsletter. 

We store the personal data you provide us with for the purpose of subscribing to the newsletter until you unsubscribe from the newsletter.

The newsletter is sent using the mailing service provider 'MailChimp', a newsletter mailing platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. You can view the privacy policy of the mailing service provider here. The Rocket Science Group LLC d/b/a MailChimp is certified under the Privacy Shield Agreement and thus offers a guarantee of compliance with the European level of data protection(PrivacyShield). The mailing service provider is used on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR and an order processing contract pursuant to Art. 28 para. 3 sentence 1 GDPR.

The mailing service provider may use the recipients' data in pseudonymous form, i.e. without assigning it to a user, to optimize or improve its own services, e.g. to technically optimize the mailing and presentation of the newsletter or for statistical purposes. However, the mailing service provider does not use the data of our newsletter recipients to write to them itself or to pass the data on to third parties.

9. duration of storage

We process and store the personal data collected from customers/users for communication, billing, accounting and marketing purposes for as long as they use our services.

If the data are no longer required for the fulfillment of contractual or legal obligations, they are regularly deleted, unless their - temporary - further processing is necessary for the following purposes:

  • Compliance with commercial, tax and other retention obligations in Switzerland: In particular, the ten-year period for keeping and storing business records (OR 958f) should be mentioned; longer periods may also result from special laws.

  • Compliance with commercial, tax and other retention obligations in Germany: In particular, the German Commercial Code (HGB) and the German Fiscal Code (AO). The retention and documentation periods specified there are two to ten years; longer periods may also result from special laws.

  • Fulfillment of commercial, tax and other retention obligations in other countries, if and insofar as bexio is active there.

  • Preservation of evidence within the scope of the respective statutory limitation periods, whereby such limitation periods can be up to 30 years or more.

Users have the following rights with regard to their personal data. We also explicitly grant these rights contained in the GDPR to Swiss customers, insofar as they are not already entitled to analogous rights under the FADP:

  • the right to information in accordance with Article 15 GDPR,

  • the right to rectification in accordance with Article 16 GDPR,

  • the right to erasure in accordance with Article 17 GDPR,

  • the right to restriction of processing in accordance with Article 18 GDPR,

  • the right to data portability in accordance with Article 20 GDPR, and

  • the right to object in accordance with Article 21 GDPR.

Any restrictions of the GDPR and the applicable national data protection laws or other national laws apply to the rights mentioned above.

If users are asked to give their consent in connection with the services of our company, they give this consent by clicking on the corresponding checkbox that our company may collect, process, use and pass on their personal data accordingly.

You can of course withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. The revocation can be sent in writing via the contact options mentioned at the beginning.

The processing of your data for the purposes mentioned in section 5 is carried out in accordance with Article 6(1)(b) GDPR for the performance of a contract. The subject matter of the contract is the above-mentioned services.
Your data is also processed, as described above, to protect the legitimate interests of our company (Article 6(1)(f) GDPR). These are the improvement of the products and services (including the delivery of direct advertising), to monitor and improve the performance of the offer and to detect, prevent or clarify illegal activities.
